‘Suspended public approbation’ for Binayak Judgment

In some sense, almost the major part of Binayak Sen’s adult life, with intermittent breaks, can perhaps be said to have been a lived example of the precept “ Our watch word must be – Doctors : go to the wounded . Don’t wait for the wounded to go to you”, uttered by another doctor – Dr. Norman Bethune of Canada- at another time.
But not stopping at that, for last few years, he, as a doctor-cum-human rights activists also had been regularly exposing the flagrant state violation of the basic citizens’ rights, which seriously affected the lives of the deprived citizenry he has been serving as a doctor in the rural hinterland of Chhatisgarh. Naturally, he was sought to be silenced by the executive organ of the state. But the character of the sessions court judgment, apart from its inanity, verges almost on the impossibility, in its (unclothed) subservience to the executive organ. This is in clear violation of the judicial service code and oath to act as impartial arbiter among the disputing parties, a violation which, in an ideal situation, calls at least for explanation by higher judicial authorities.
On the other hand did the very wording of this rambling judgment on Dr. Binayak Sen and two others (Piyush Guha, Narayan Sanyal), have a hidden agenda of sabotage, on conscious or sub-conscious plane, from the very inside! Is it possible that the text of the trial court judgment, delivered under visible/audible extra-judicial compulsion, seek to ensure that the highly unreasonable sentence of Life Imprisonment delivered fails to stand scrutiny in appellate courts and ultimately overturned in the not too distant future?
