Dr. Sandeep Pandey (Activist on Fast for 10 Days)

While the morale of those fasting for the past six days (Dr. Sandeep Pandey, ComPrem Narain Verma, Ram Prakash & Faizal Khan) was very high and hopeful, the BJPGovernment in the State demonstrated its total indifference and apathy towards democratic& peaceful method of protesting through Fasting. Expressing concern at the growing ruthlesscharacter of the State, Dr. Sandeep Pandey (Magsaysay Award Winner) said that the failureof the state to listen to the voices of peaceful protest and respond to the people’s cries arethe major reasons for resorting to extra-parliamentary means by the victims of injustice andviolence.

Dr. Sandeep Pandey also referred to an article entitled “Gandhi! Tum Nikal BhagoChadm Gandhivadiyon ke beech se” (Gandhi! You must escape from the midst of pseudo-Gandhians!) by Sri Vishwaranjan, Director General of Police of Chhattisgarh appearing inthe Hari Bhoomi daily published from Raipur, the capital city of Chhattisgarh. In this article,the DGP has poked fun at the Group Fasting and those participating in it.

The Group Fast against the Black Law (in Chhattisgarh) and for the release of Dr.Binayak Sen, Ajay T G and others entered its 6th day with 47 members of Ekta Parishad(Kanker) led by Mr. Ratneshwar Nath joining in the 24-hours dharna/chain fasting, 9members of Baiga Mahapanchayat (Lormi) led by Ms. Rashmi Diwedi, while 9 membersfrom Chhattisgarh Mukti Morcha (Jamul) led by Adv Sudha Bhardwaj completed their 24-hours fasting today. Others who joined in support and solidarity were Dr. Anurag Bhargavaof Jan Swastha Abhiyaan (Ganiyari, Bilaspur), Dr. Ilina Sen, Ms. Chandrika and Ms. Nazma(Roopantar), Arundhati, Sirish Agraal, Jontahan, Anurag Tiwari (Asha Parivaar, Lucknow),besides regular volunteers from Chhattisgarh Bal Shramik Sangathan, Asha Parivaar &PUCL.

From Ekta Parishad, those who spoke at the occasion were Ratneshwar Nath,Shivrani ji, Dashrath Markaam, Aagantu Ram, Sunder Markam, Bishu Pardi. Others whospoke expressing solidarity with the cause were Dr. Anurag Bhargava of Jan SwasthaAbhiyaan, Adv Gautam Bandopadhyay, Nadi Ghati Morcha. Mukti songs were sung byChandrika of Roopantar, and Kumud Nandgave, Ramesh Dewangan of Chhattisgarh BalShramik Sangathan.

When the issue is class struggle, everyone knows that today’s judiciary in India exhibits no qualitative difference from that of the British colonial regime. When workers try to hold gate meetings, management goes to court and readily gets orders prohibiting meetings within a kilometre distance from the factory gate. When workers are forced to resort to strikes, then the police, judiciary, administration along with whichever parliamentary political party is in government become active, strikes are swiftly (even eagerly) declared illegal and proceedings begin to suppress the protest by severe police force. The police have a distressing record of willingness to apply third degree methods and engineer lock-up deaths on management allegations against workers, and judicial intervention is to say the least rare. An open alliance of the highest court with one side of the class struggle is the only reasonable conclusion to draw from the recent decision in T.N. Rangarajan vs. State of Tamil Nadu, holding that workers lack any fundamental, legal or moral right to strike. But management can resort to lockouts or closure, evade payment of gratuity, eat away workers’ PF and ESI funds, and know that they face at worst insignificant penalties and never police action.

The People’s Union for Civil Liberties (Chhattisgarh Unit) release a list of more than 70 organizations from about 25 states of India, Pakistan, Bangladesh, UK, USA, and other nations who have endorsed the campaign for the release of defenders of human rights like Dr. Binayak Sen, Ajay T G, and Ors, who have been detained under the draconian law called The Chhattisgarh Special Public Security Act 2005 and Unlawful Activities Prevention Act 1967 (Amended in 2004).

In a press release issued today, Adv Rajendra K Sail, President, CG-PUCL informed that the 10-day Group Fast began on 16th June, 2008 at Raipur around 2 pm to express solidarity with Dr. Binayak Sen (Medical Doctor), Ajay T G (Film Maker), both members of the PUCL, and many others detained under the draconian Chhattisgarh Special Public Security Act 2005, and the Unlawful Activities Prevention Act (1967) amended in 2004.
